TERMS & CONDITIONS
 
Please read the following Booking Terms and Conditions (Agreement) carefully.
 
Welcome to our Whale and Ocean Moorea expedition! By booking and participating in our tour, you agree to the following terms and conditions. Please read them carefully before making your reservation.

### 1. Booking and Payments
1.1. To secure your spot on the tour, a non-refundable deposit of $750 USD is required at the time of booking ($1000 for private rooms). 
1.2. $1,381.67 USD ($2,930.00 USD for private room) to be paid on or before 15 April 2026, $1,381.67 USD ($2,930.00 USD for a private room) to be paid on or before 15 June 2026, $1,381.67 USD ($2,930.00 USD for a private room) to be paid on or before 15 July 2026.
1.3. Payments can be made through our secure online payment system.

### 2. Cancellations and Refunds
2.1. If you need to cancel your booking, please notify us in writing as soon as possible.
2.2. Cancellations made before 15 April 2026 will receive a refund of the amount paid minus the non-refundable deposit.
2.3. Cancellations made after 15 April 2026 will not be eligible for a refund.
2.4. In the unlikely event that we need to cancel the tour, a full refund will be provided.

### 3. Inclusions and Exclusions
3.1. The tour package includes:
   - Accommodation as specified in the itinerary
   - 2 meals a day either breakfast and lunch or breakfast and dinner. 
   - Guided tours and activities as specified in the itinerary.
   - Transportation and transfers for specified activities ONLY on the itinerary.
   
3.2. Airport & Ferry Transfers
   - Guests must arrive on their own accord to French Polynesia/Tahiti Faaa International Airport on or before 15th September, 2026. The retreat starts on the 15th September 2026 at 1400pm at Marina Moorea (Moorea's ferry terminal). Guests will need to organise their own ferry transfers between Tahiti & Moorea (return journey). Upon arrival to the ferry terminal on 15th September 2026 @ 1400pm, a complimentary transfer will be waiting to escort guests to the villa.
   - Only transfers for specified activities for the retreat will be included
   - The retreat will start at Marina Moorea at 2pm on the 15th September 2026.
   - To avoid any complications with flights (delays ect.) guests are encouraged to arrive on the 14th September to French Polynesia/Tahiti and spend the night at a hotel or Airbnb in Tahiti to ensure they get to the meeting point at 2pm on the 15th September 2026 at Marina Moorea.

3.3. The tour package does not include:
   - International airfare to and from French Polynesia.
   - Travel insurance (mandatory).
   - Personal expenses (e.g. alcoholic beverages, souvenirs).
   - Optional activities that are not included in the itinerary.
   - Gratuities.
   - Transfers for non specified itinerary lunches, dinners, activities and any other items.
   - Ferry trip to and from Moorea back to Tahiti

### 4. Health and Safety
4.1. Participants are responsible for ensuring they are in good health and physically capable of participating in the tour.
4.2. It is mandatory for all participants to have comprehensive travel insurance that covers medical expenses, trip cancellation, and personal liability.
4.3. We reserve the right to refuse participation to anyone deemed unfit for the tour.

### 5. Travel Documents and Visas
5.1. Participants are responsible for obtaining and carrying valid passports, visas, and any other necessary travel documents.
5.2. We are not responsible for any issues arising from incorrect or incomplete travel documentation.

### 6. Itinerary Changes
6.1. While we strive to adhere to the published itinerary, changes may occur due to weather conditions, safety concerns, or other unforeseen circumstances.
6.2. We reserve the right to make changes to the itinerary as needed, and participants will be informed as soon as possible.

### 7. Liability
7.1. We are not liable for any injuries, losses, or damages incurred during the tour, except in cases of gross negligence on our part.
7.2. Participants are responsible for their personal belongings and valuables during the tour.

### 8. Code of Conduct
8.1. Participants are expected to behave respectfully towards other tour members, guides, and local communities.
8.2. Any behaviour deemed disruptive or harmful may result in the participant being asked to leave the tour, with no refund provided.

### 9. Governing Law
9.1. These terms and conditions are governed by the laws of The Republic of French Polynesia.
9.2. Any disputes arising from these terms and conditions will be subject to the exclusive jurisdiction of the Republic of French Polynesia courts.
